CA HR 35 Raises Issues of Free Speech on University Campuses

In August, the California Assembly passed resolution HR 35, urging University of California officials to do more to fight anti-Semitism on university and college campuses. The resolution suggested the European definition of anti-Semitism be used.

Language in the resolution has led to the interpretation that even some peaceful university protests against specific Israeli government policies should be prohibited as ethnically-motivated, hateful, or dangerous.

The Assembly made its statement in a resolution, not a bill with legally-enforceable changes to current law in California. Even so, the resolution has sparked controversy with UC administration, students, and the California legislature as it has put the issues of free speech and the Israeli-Palestinian conflict in the spotlight.

The student reaction to the resolution, both for and against, was vocal and impassioned from the start. Earlier this month, the University of California Student Association (UCSA) passed a resolution condemning HR 35 and taking a step further, made a veiled suggestion that the University of California should divest from Israel. Following the UCSA?s statement, the Daily Californian released an op ed piece supporting HR 35 and denouncing the statement of opposition.

The arguments shaping up on both sides often use dichotomous language, making their recommended solutions polar and divisive in nature. HR 35 links any protest against Israel?s government with violence and antisemitism. If this definition were accepted it could inevitably lead to censorship as even an open discussion on the Israeli government?s policy can be classified as a protest and shut down.

Instead of solely attacking censorship, the USCA?s statement tied the issue to divestment, failing to parse the issues, stoking controversy, and raising the stakes even higher. The threat of divestment has historically been a powerful tactic student populations have used with great success.

Protests on university campuses in the 1970s and 1980s led to widespread divestment from South Africa. This has scared many Jewish and Zionist citizens. Taking the arguments of both sides of the debate seriously would mean a choice between censorship or divestment from Israel. These, of course, are not the only options.

The University of California President?s office (UCOP) has taken a steady middle path through the controversy. Since the UC administration cannot be dictated to by the state legislature and HR 35 is a nonbinding resolution, UCOP has declined to come out for or against the resolution.

The report helped the UC administration to stay in the fragile middle of the argument by making nods to both sides without supporting significant changes to current policy.

With HR 35 focusing on a heated issue like Israel and antisemitism, a heated and ideologically diverse dialogue about Israel and Palestine ensued. Much of that dialogue, however, has overlooked the fact that this resolution calls for censorship of free speech on university campuses.

The Verizon Wireless version of the iPhone 5, which went on sale Friday, comes with a secret and unexpected feature: it works on AT&T's network as well.

Confirming blog reports, The Associated Press found that a Verizon iPhone 5 accepts an AT&T "SIM card" ? a chip that identifies a phone to a network. The phone can then be active on AT&T's network.

It's the first time Verizon iPhones have been able to access AT&T's network without complicated hacking procedures. The feature gives Verizon customers the option to switch carriers rather than renewing an expired contract.

It's unclear whether the feature is intended and whether the phones will work with other carriers such as T-Mobile USA.

Verizon Wireless referred questions about the SIM card feature to Apple, which did not respond.?

Georgian protesters demand prosecutions for abuse

TBILISI, Georgia (AP) ? Thousands rallied Friday in Georgia to demand the prosecution of top officials fired in a prison abuse scandal that threatens to unseat the governing pro-Western party in the country's Oct. 1 parliamentary election.

The protests, sparked by graphic videos showing guards in the former Soviet republic brutally beating prisoners and raping them with truncheons and broom handles, have ratcheted up the pressure on President Mikhail Saakashvili, whose party is facing a tough opposition challenge.

Saakashvili has sought to contain the damage by firing his interior minister and the minister in charge of the penitentiary system while also reshuffling prison personnel.

But despite these efforts, protesters increased their demands as rallies went into a third day Friday, insisting that former Interior Minister Bacho Akhalaya and his brother, who was a deputy defense minister, be brought to justice.

An opposition victory in the Oct. 1 vote would make its multibillionaire leader, Bidzina Ivanishvili, Georgia's prime minister. Ivanishvili would then become Georgia's No. 1 leader next year, after Saakashvili's second and final term ends, thanks to a political reform that will shift powers from the presidency to the parliament and the prime minister.

Ivanishvili and his allies have cautioned their supporters against taking to the streets, apparently fearing a government crackdown that may derail the vote and steal what they hope will be their victory.

While not denying that the prison abuse took place, Saakashvili's government has accused the opposition of staging the videos and waiting to broadcast them until the final weeks of the election campaign. One of the two channels that aired the videos belongs to Ivanishvili.

Both sides have expressed a desire for the election to take place peacefully.

"Elections must be held in a quiet environment," Manana Kobakhidze, a leading member of Ivanishvili's Georgian Dream coalition, said on the independent Maestro television late Thursday. "Let people express their opinion at the polls."

Students, who have been the main driving force in the protests, heeded the call Friday, vowing to suspend their involvement in street protests until after the vote. But many other Georgians outraged by the prison abuse continued to protest.

Hundreds of demonstrators gathered overnight outside the Gldani prison in Tbilisi where the videos of abuse were filmed, stopping several prison vans and asking prisoners inside whether they had suffered abuse.

One prisoner, who identified himself as Shota Nikolaishvili, shouted back, saying that he had been repeatedly beaten by guards. "I have lost my health here and I fear nothing now," he cried.

The new penitentiaries minister, Giorgy Tugushi, visited the prison on Friday and promised change.

"Everything will be improved gradually," he said. "Of course I do not exclude that some incident might happen here, there may be some unworthy people still left in the system, but in the nearest future everything will be improved."

Demonstrators also gathered outside another prison in the city of Rustavi. One protester, Mary Kiknadze, said her son in there had been repeatedly beaten.

"They punished him for letting me know about their abuse of prisoners," she said. "This government is torturing people to make them confess to crimes they haven't committed."

The European Union has strongly condemned the abuse of prisoners and urged the Georgian authorities to punish the culprits.

EU foreign policy chief Catherine Ashton said she is "appalled by the shocking footage of abuses committed against inmates in Gldani prison."

"It is of vital importance that these and other incidents are thoroughly and transparently investigated and that those responsible are held to account," she said in a statement.

Rupert Colville, a spokesman for the United Nations human rights office in Geneva, urged Georgia to "promptly, impartially and effectively" investigate all cases of abuse and take steps "to ensure that prisons and detention centers are managed in line with international human rights law and standards."

The foreclosure-to rental market continues to flourish, with major investors sweeping up foreclosed homes and turning them into profitable rentals. Banks are backing that effort by lending to well-established investors. The Wall Street Journal reports that California investor Waypoint Real Estate Group secured a loan for $65 million from Citigroup and is working on an even larger long-term financing deal with the bank. In January, the company received $250 million from a private equity firm.

Last August, I wrote about private equity and hedge funds buying single-family homes, a trend that began when the housing market crashed, which picked up steam earlier this year with the Federal Reserve's support of the purchases in order to reduce the backlog of foreclosures.

Most of the investing groups that have emerged are buying foreclosed properties in bulk, but Waypoint buys homes one at a time. The company, formed in 2009, owns more than 2,200 homes and wants to up that to more than 11,000 by the end of 2013. Most of their leases are for two years in order to encourage renters to remain in the property.

Another hedge fund, Colony Capital LLC, launched a unit called Colony American Homes in January and already owns 3,600 homes.

Arrest Made In Arrow Attack On Two Cats - KPLR 11

VERSAILLES, MO. (KPLR) ? The Humane Society of Missouri Animal Cruelty Task Force and the Morgan County Sheriff?s Office have arrested a suspect in the shooting of two adult cats with arrows, Versailles, MO.

The suspect is a Versailles area resident. Animal abuse charges are expected to be filed, on the charges of felony animal abuse, which carries a jail sentence of up to four years and/or a fine of up to $5,000 for each count.

The cats, both two-year-old males named Patches and Licorice, were shot in the neck with the arrows. They?re being treated for pain and infection at the office of a local veterinarian and will be transferred to the Humane Society of Missouri Headquarters where they have continued to receive care. Patches, who had the larger wound, is still in danger of losing a leg as a result of the injuries he sustained. Licorice has nerve damage along the path of the arrow which may or may not resolve as he recovers. The hope is that both cats will eventually be rehabilitated and adopted.
