News organizations refuse off-the-record meeting with Holder

WASHINGTON (AP) -- A plan by Attorney General Eric Holder to hold meetings with news organizations about guidelines governing investigations that involve reporters has run into snags over the terms of discussions.

The Justice Department wants the meetings to be off the record. The Associated Press issued a statement saying it wants any meeting to be on the record, meaning it could be the subject of news stories. And The New York Times said it won't attend because of the department's off-the-record ground rules.

The review of the guidelines called for last week by President Barack Obama come as the Justice Department deals with an outcry over its secret gathering of AP reporters' phone records and the emails of a Fox News journalist.

AP media relations manager Erin Madigan White said that if the session is not on the record, the news cooperative will offer its views in an open letter on how Justice Department regulations should be updated.

If the AP's meeting with the attorney general is on the record, AP Executive Editor Kathleen Carroll will attend, White said. She said AP expects its attorneys to be included in any planned meetings between the attorney general's office and media lawyers on the legal specifics.

New York Times Executive Editor Jill Abramson said in a statement: "It isn't appropriate for us to attend an off the record meeting with the attorney general. Our Washington bureau is aggressively covering the department's handling of leak investigations at this time."

The planned meetings are to take place over the coming weeks. The department said Holder plans to engage with news media organizations, including print media, wire services, radio, television, online media and news and trade associations. Discussions are to include news media executives and general counsels as well as government experts in intelligence and investigative agencies.

The initial meetings over the next two days are to be with several Washington bureau chiefs of national news organizations.

Obama has asked Holder to report to him on any recommended policy changes by July 12.

Seabrook's OT goal lifts Blackhawks past Red Wings

CHICAGO (AP) ? When the Chicago Blackhawks were on the brink of playoff elimination, they had the feeling that all they needed was one win to turn it around.

They were right.

Brent Seabrook sent a wrist shot past Jimmy Howard's glove 3:35 into overtime, and the Blackhawks completed an improbable comeback with a 2-1 victory over the Red Wings in Game 7 of their second-round playoff series on Wednesday night.

"You go back to after Game 4," coach Joel Quenneville said. "Their approach and the belief in the room, and each other, was there. It was a strong season and we had to find a way. I think winning here in Game 5 got us excited again and got the momentum back.

"The last two games were tightly fought and amazing games."

The Blackhawks, who had the best record in the NHL regular season, rallied from a 3-1 series deficit to reach the Western Conference finals against the defending Stanley Cup champion Los Angeles Kings.

For just the second time in NHL history, the final four teams remaining in the playoffs are the four most recent Stanley Cup winners. Chicago captured the Cup in 2010.

Seabrook picked up a loose puck and skated in on Howard through the middle of the ice, with Detroit defenseman Niklas Kronwall in front of him. His shot hit Kronwall's leg before it sailed into the left side of the net for the defenseman's first goal of the postseason.

"I don't know if I saw it go in to be honest," Seabrook said. "I just heard the horn going and the boys jumping out. It was a pretty exhausting game, but I think I was more tired during the celebration with guys jumping and pushing me in the face and dragging me down.

"It's exciting. You don't get to do that too many times."

The sellout crowd of 22,103 roared as Seabrook skated over to the boards and was mobbed by his delirious teammates.

Howard put his arm around Kronwall, who was down on one knee, and tried to console him while the Blackhawks celebrated.

"It's tough. How do you get upset at someone who's sacrificing their body out there to block shots?" Howard said. "Kroner has been huge for us all year and you know, he doesn't deserve that luck."

It was quite a change from the end of the third period, when the Blackhawks thought they had scored the go-ahead goal. But it was waved off with less than 2 minutes remaining by referee Stephen Walkom, who called a pair of penalties behind the play.

Patrick Sharp put Chicago in front in the second period, but Henrik Zetterberg tied it in the third for No. 7 Detroit, which beat second-seeded Anaheim in seven games in the first round. Howard finished with 33 saves.

"They're a very talented group," Detroit coach Mike Babcock said. "I think we pushed them very hard in the series and had a lot of fun doing it."

Chicago made it to the conference finals for the first time since it won the title three years ago and will host Los Angeles in Game 1 on Saturday. The Kings advanced with a 2-1 victory over San Jose in Game 7 on Tuesday night.

Pittsburgh will host Boston in the opener of the Eastern finals on Saturday.

Chicago was one of the favorites to win the Stanley Cup when the playoffs began, storming to the Presidents' Trophy during the lockout-shortened season. The Blackhawks then boosted their credentials with a five-game win over Minnesota in the first round and a convincing 4-1 victory against the Red Wings in the series opener.

But Howard and Detroit responded with three straight victories, pushing Chicago to the edge of elimination. The frustrated Blackhawks held a team meeting the day after Game 4, where the seeds were planted for their improbable comeback.

Three victories later ? in which the Blackhawks outscored the Red Wings 10-5 after managing just two goals in Games 2-4 ? they became the 25th team to win a series after trailing 3-1. It was the first time in franchise history Chicago has made such a comeback.

"We dug really deep," captain Jonathan Toews said. "We came in here and asked ourselves a question: How bad we wanted it. You got your answer right there. That's a heck of a way to pull out four wins in seven games."

Crawford finished with 26 saves, continuing his strong performance after allowing a soft goal that nearly proved costly in Game 6. He was especially tough after Detroit turned up the pressure early in the third.

The Blackhawks celebrated wildly when Niklas Hjalmarsson blasted a slap shot by Howard with 1:47 left in regulation, prompting cheers from the raucous crowd.

But Chicago forward Brandon Saad and Detroit defenseman Kyle Quincey got tangled up in front of the Red Wings bench. Walkom stopped play to give roughing penalties to both players as the Blackhawks went in for what appeared to be the go-ahead goal.

"It was getting to the point where he had to call the penalty, I guess. We were going back and forth," Quincey said. "I guess it worked in our favor there."

Toews had a long discussion with one of the officials while the cheers turned to boos as the crowd realized the goal was waved off. The Red Wings then rushed down the ice, and Johan Franzen's shot was blocked by defenseman Duncan Keith.

After a seesaw series with all sorts of twists and turns, Chicago and Detroit faced off one more time in a Western Conference playoff game. The Red Wings will move to the East after this season as part of NHL realignment while the Blackhawks remain in the West.

Playing on soft ice due in part to The Rolling Stones concert on Tuesday night, the Original Six teams provided a fitting conclusion to a compelling series.

"You have to give the Red Wings credit," Sharp said. "They're a well-coached team, they keep coming at you. Each game could have gone the other way. But we have to be proud of ourselves in this locker room for being able to battle back."

The Blackhawks got an opening at the start of the second period when Sharp got Kronwall to turn the puck over while the Red Wings changed lines. Sharp then skated in with Michal Handzus and Marian Hossa and finished a pretty passing sequence with his seventh goal of the playoffs at 1:08.

The Red Wings tied it at the beginning of the third. Gustav Nyquist made a nice move to get open along the boards and found a streaking Zetterberg on the left side for the captain's first goal since the Red Wings' 3-2 victory at Anaheim in Game 7 of the first round.

"To go all the way, you need a lot of luck," Detroit forward Daniel Cleary said. "You need to be healthy to win. The last five teams that won Cups were still alive. There's probably a reason for that. They're a good team. I mean, tip your hat to them. They played well."

NOTES: Detroit C Valtteri Filppula didn't return after leaving in the first period with an undisclosed lower body injury. ... It was the third Game 7 between the Red Wings and Blackhawks. Detroit won 4-2 in 1964, and Chicago returned the favor by the same score a year later. ... NYC police: Notes to Obama, mayor had gun threats

WASHINGTON (AP) ? A suspicious letter mailed to the White House was similar to two threatening, poison-laced letters on the gun law debate sent to New York Mayor Michael Bloomberg, one of the nation's most potent gun-control advocates, officials said Thursday.

The Secret Service said the letter was addressed to President Barack Obama and was intercepted by a White House mail screening facility. Two similar letters postmarked in Louisiana and sent to Bloomberg in New York and his gun control group in Washington contained traces of the deadly poison ricin.

It wasn't immediately clear whether the letter sent to Obama contained ricin. It was turned over to the FBI's Joint Terrorism Task Force for testing and investigation.

The two Bloomberg letters, opened Friday in New York and Sunday in Washington, contained an oily pinkish-orange substance.

New York Police Department Commissioner Raymond Kelly said Thursday that all three letters apparently came from the same machine or computer and may be identical but referred specific questions to the FBI.

The body of the letter mailed to New York was addressed to "you" and referenced the gun control debate. Kelly said the unsigned letter says, in so many words: "Anyone who comes for my guns will be shot in the face." He refused to quote directly from the letter, saying he didn't want to do the author's bidding.

Bloomberg has emerged as one of the country's most important gun-control advocates, able to press his case with both his public position and his private money.

The New York letter was opened at the city's mail facility in Manhattan in a biochemical containment box, which is a part of the screening process for mayor's office mail.

"In terms of the processes and procedures that are in place now we think they worked," Kelly said. "This is sort of an effect of the post-9/11 world that we live in that these checks and facilities are in place and the system worked."

The second letter was opened Sunday by Mark Glaze, director of Mayors Against Illegal Guns, the Washington-based nonprofit Bloomberg started.

The letter Glaze opened tested positive for ricin initially. The other letter to Bloomberg at first tested negative but tested positive at a retest Wednesday.

The postal workers union, citing information it got in a Postal Service briefing, said the letters bore a Shreveport, La., postmark. Kelly would not comment on the origin of the letter.

Louisiana State Police spokeswoman Julie Lewis said state authorities have deferred to the FBI and have not opened an investigation. The Shreveport postal center handles mail from Louisiana, Texas and Arkansas, so the letter could have come from any of those states, Lewis said.

The people who initially came into contact with the letters showed no symptoms of exposure to the poison, but three officers who later examined the New York letter experienced minor symptoms that have since abated, police said. The mayor visited the mailroom on Thursday but made no public comments on the topic.

On Wednesday, he said he didn't know why they were sent.

One of the letters "obviously referred to our anti-gun efforts, but there's 12,000 people that are going to get killed this year with guns and 19,000 that are going to commit suicide with guns, and we're not going to walk away from those efforts," said Bloomberg, adding that he didn't feel threatened.

According to the federal Centers for Disease Control and Prevention, ricin is a poison found naturally in castor beans. Symptoms can include difficulty breathing, vomiting and redness on the skin depending on how the affected person comes into contact with the poison.

The letters were the latest in a string of toxin-laced missives, but authorities would not say whether the letters to Bloomberg and Obama were believed to be linked to any other recent case.

In Washington state, a 37-year-old was charged last week with threatening to kill a federal judge in a letter that contained ricin. About a month earlier, letters containing the substance were addressed to Obama, a U.S. senator and a Mississippi judge. One of the letters postmarked in Memphis, Tenn., was traced back to Tupelo, Miss., and a Mississippi man was arrested.

Bloomberg and Boston Mayor Thomas Menino founded Mayors Against Illegal Guns, which now counts more than 700 mayors nationwide as members. It lobbies federal and state lawmakers, and it aired a spate of television ads this year urging Congress to expand background checks and pass other gun-control measures after the school shooting in Newtown, Conn. The background check proposal failed in a Senate vote in April, and other measures gun-control advocates wanted ? including a ban on sales of military-style assault weapons ? have stalled.

Separately, Bloomberg also has made political donations to candidates who share his desire for tougher gun restrictions. His super PAC, Independence USA, put $2.2 million into a Democratic primary this winter for a congressional seat in Illinois, for example. Bloomberg's choice, former state lawmaker Robin Kelly, won.

Regulators told to crack down on predatory payday lenders

LONDON (Reuters) - The consumer watchdog must get tough on unscrupulous short-term lenders that target the financially vulnerable and lend them money they can't afford to repay, a parliamentary committee said on Friday.

The Public Accounts Committee (PAC) said bad practices by some of these firms were costing already hard-pressed borrowers at least 450 million pounds a year.

So-called payday lenders, which offer loans that are repaid when borrowers get their wages, have grown rapidly in Britain as banks cut back on short-term credit after the 2008 financial crisis. But they have been criticised for charging sky-high interest rates and for shoddy treatment of customers.

The committee's call for a crack-down on some of these firms follows its review of how effectively Britain's 176 billion pound a year consumer lending industry is regulated.

Committee Chairwoman Margaret Hodge said some lenders used predatory techniques to target vulnerable people on low incomes, encouraging them to take out loans which, when rolled over with extra interest, rapidly became out of control debts.

She said the regulator, the Office of Fair Trading, had been ineffective and timid in its handling of the sector. The OFT had never given a fine to any of the 72,000 firms in the market and very rarely revoked a company's license, Hodge said.

The OFT said in response it had taken "strong, targeted action to tackle the areas of greatest risk to consumers." The OFT said its powers were limited and that it was only able to impose fines in very limited circumstances.

In March, the OFT gave Britain's biggest 50 payday lenders 12 weeks to change their business practices or risk losing their licenses after finding evidence of irresponsible lending. The watchdog said on Friday it had since closed down three payday lenders and opened formal investigations into three others.

Wonga, one of the biggest payday lenders in Britain, more than trebled its earnings last year. Its annual percentage interest rate is listed on Wonga.com as 4,214 percent.

The firm has said it makes stringent checks on borrowers and turns down two-thirds of applications. It has called for tighter control and regulation to stamp out the worst practices within the industry.

The parliamentary committee said that annual percentage interest rates were misleading to borrowers and should be replaced by a legally required statement of the total amount that borrowers must repay. It also recommended that the OFT increased the license fees it charges lenders to provide more money for regulating them.

The OFT will cease to exist in 2014 and will hand over regulation of the sector to the newly-created Financial Conduct Authority (FCA). The committee recommended that the FCA has better intelligence so it can improve protection of consumers and should apply tougher sanctions when it identifies wrongdoing.

The Citizens Advice Bureau, a charity that helps people with legal and financial issues, on Tuesday accused payday lenders of bullying borrowers into extending loans and harassing those heavily in debt.

Spotify is making another push to help its users find more music they're interested in listening to, and find out more about the artists they like by making its "Discover" feature available to all. Initially shown off late last year, this page combines several elements that have already been a part of the music service, including apps like Pitchfork, Songkick and Tunigo with its song recommendations and followed artist pages. There's also an audio preview feature to let you easily dip into a song that seems interesting, without pulling the focus away from whatever you were listening to before.

The new page is available today on Spotify's web player for all users, and is expected to come to its desktop and mobile clients "gradually." Nordic diet lowers cholesterol, study finds

May 29, 2013 ? A healthy Nordic diet lowers cholesterol levels, and therefore the risk of cardiovascular disease, a pan-Nordic study where Lund University participated has found. There was also decreased inflammation associated with pre-diabetes.

- The subjects who ate a Nordic diet had lower levels of harmful LDL cholesterol and higher levels of "good" HDL cholesterol. The amount of harmful fat particles in the blood also declined, says Lieselotte Cloetens, a biomedical nutrition researcher at Lund University.

The 'healthy Nordic diet' used in the study contains local produce such as berries, root vegetables, legumes, and cabbage. Nuts, game, poultry and fish are also included, as well as whole grains, rapeseed oil and low-fat dairy products. The rest of the group ate butter instead of rapeseed oil, less berries and vegetables, and had no rules on red meat or white bread intake.

The researchers now want to focus on the diet's ability to maintain weight loss in a new study, according to Lieselotte Cloetens, who points out that the problem with most diets is maintaining the results.

How can this disconnect be resolved?

  • South Barrington home buyers can wait the market for as long as they want until a house that is younger in age hits the market but who knows how long they?ll have to wait. They should also know they have competition. To think you are the only person looking for a younger house in South Barrington and make an offer based on that thought, will likely mean your offer will be trumped by someone else.
  • Dare I say look elsewhere? Likely not because South Barrington is known to be the best in 60010 for the luxury properties and location here is king!
  • Low ball offers until you score? Again this rarely works. Listing agents don?t just pluck numbers from the sky when they advise sellers what homes should sell for. We look at comparable sales. So sellers are not going to give in and sell because you try to get a cheap house. Knowing the market is more than knowing a price, it?s also about knowing market action, average market times, your competition.
  • Watch the mortgage interest rates. Absolutely. There has never been a time to get jumbo mortgages at such a low rate. Even this week we have seen the rates rise and this might affect your monthly outgoings more than you think. Lower payments could provide you the money you need to upgrade or change a house to be what you want it to be.
  • South Barrington home sellers cannot change the age of their homes but it might be worth updating the property to make it appeal to those buyers. Kitchens and bathrooms sell houses but windows, roofs and driveways are also big ticket items that buyers look at.

Either way there?s no way of making South Barrington?s housing stock any younger, buyers cannot tag older kitchens or windows as worthless, ?and something will have to give. With mortgage rates on the rise buyers may have to grasp hold of the fact that they cannot get all that they desire and take the plunge before prices start to rise. These limited choices are fully functioning and quite frankly beautiful homes,so why not update them over time. Sometimes you have to give to get, and an older kitchen in a superb waterfront location is an example.

2 foreigners abducted in main Yemeni city

SANAA, Yemen (AP) ? Security officials say gunmen have abducted two foreigners outside their hotel in Taiz, Yemen's second largest city.

Police say the two were taken at gunpoint by unknown assailants outside the Taiz Plaza hotel on Monday.

The officials spoke anonymously in line with regulations. Neither police nor the hotel's management would comment on the nationality of the two foreigners.

It's the first abduction of foreigners in Taiz, on the southwestern tip of the Arabian Peninsula.

Yemen's president has warned that the al-Qaida branch in the country is expanding and using assassinations and abductions of foreigners as a way to challenge the central authority.

The group claimed responsibility in March 2012 for killing an American teacher in Taiz, saying in a post on militant websites that he was proselytizing for Christianity.

Suspected killer of British soldier was held in Kenya

LONDON/NAIROBI (Reuters) - One of two men arrested over the murder of a British soldier in a London street was detained in Kenya in 2010 on suspicion of seeking to train with an al Qaeda-linked group in Somalia, Kenyan police said on Sunday.

Confirmation that Michael Adebolajo was held in Kenya and deported to London will intensify calls for Britain's spy agencies to explain what they knew about the suspect and whether they could have done more to prevent Lee Rigby's killing on Wednesday.

The British parliament's security committee will next week investigate the security services' actions in the run-up to a killing that has put pressure on Prime Minister David Cameron to take a harder line on radicals.

The Nairobi government initially said Adebolajo had never visited Kenya. But on Sunday, Boniface Mwaniki, head of Kenya's anti-terrorism police, said Adebolajo was arrested in November 2010 and deported to Britain.

"He was arrested with a group of five others trying to travel to Somalia to join militant group al Shabaab," he told Reuters.

The Islamist force, which is linked to al Qaeda, wants to impose a strict version of Islamic law across Somalia.

A Foreign Office spokeswoman in London confirmed the arrest and said consular officials had provided assistance.

Adebolajo, 28 and Michael Adebowale, 22, are under guard in hospital after being shot and arrested after the murder of the 25-year-old Afghan war veteran. They have not been charged.

Spy agencies have come under scrutiny after uncorroborated allegations by a friend of Adebolajo on Friday that intelligence officers tried to recruit him six months ago.

Asked whether the security services had contacted the men, Home Secretary (interior minister) Theresa May told the BBC: "Their job is about gathering intelligence. They do that from a variety of sources and they will do that in a variety of ways. And yes, they will approach individuals from time to time."

A source close to the investigation told Reuters this week that both suspects were known to the MI5 domestic security service. However, neither was thought to pose a serious threat.

'POISONOUS NARRATIVE'

The government also said it is forming a group to combat radical Muslim preachers and others whose words could encourage violence.

Prime Minister David Cameron's office said the group aimed to fight radicalism in schools and mosques, tighten checks on inflammatory internet material, and disrupt the "poisonous narrative" of hardline clerics.

Rigby's killing fuelled public anger about radical Islam. It has also raised questions over whether more could have done more to prevent the attack and put pressure on Cameron to tackle suspected militants more forcefully.

Witnesses said the soldier's killers shouted Islamist slogans during the attack. Bystanders filmed one of the suspects saying it was in revenge for Britain's involvement in the wars in Iraq and Afghanistan.

Successive British governments have wrestled with how to prevent people from becoming radicalized without alienating the wider population with draconian measures.

Former British prime minister Tony Blair tried to tighten rules against hate preachers after the London bombings in 2005 that killed 52 commuters. The measures stirred a long debate over how to balance free speech and civil rights with a strong counter-terrorism strategy.

Britain's two-party coalition government is divided over a planned new law that would allow police and spy agencies to monitor people's use of the internet and mobile phones.

The Muslim Council of Britain, a religious umbrella group, said new government measures risked "making our society less free, divided and suspicious of each other".

How the smartphone killed the three-day weekend

Really, dude? The concept of a three-day weekend has gone the way of the dodo. Are companies to blame, or are we?

Memorial Day weekend marks the beginning of summer and all it evokes: vacations, slower workweeks, casual dress codes, getting the pool ready and pulling out the outdoor furniture.

It would seem an ideal time to take a break, but our ability to unplug and relax is under assault. A three-day weekend? We can barely get through three waking hours without working, new research shows.?The average smartphone user checks his or her?device 150 times per day, or about once every six minutes.?Meanwhile, government data from 2011 says 35 percent of us work on weekends, and those who do average five hours of labor, often without compensation -- or even a thank you. The other 65 percent were probably too busy to answer surveyors? questions.

There's plenty of debate among economists and psychologists over whether the economy is to blame, or whether we did this to ourselves.?There's little arguing that the concept of a Sabbath is in serious danger.?

?It's like an arms race?everything is an emergency," said Tanya Schevitz, spokeswoman for Reboot, an organization trying help people unplug more often. "We have created an expectation in society that people will respond immediately to everything with no delay. It's unhealthy, and it's unproductive, and we can't keep going on like this."?

There's a long list of horribles associated with our new, always-on-digital lives: You are dumber. You are more stressed. You are losing sleep, and more depressed.

People seem to know they need tech breaks, which have plenty of cute names now, like "Digital Detox" or "Tech Sabbath." Consumers pay for software like "Freedom," which cuts their computers off the Net for a pre-set amount of time (really, you could just unplug yours). Reboot even sponsors a National Day of Unplugging, which will occur in March next year. But no one seems to think the problem is getting any better.

It?s easy to blame the economy. Workers competing for too few jobs feel like they can't say no to their boss, even if it's a trivial request during a long weekend.?It?s equally easy to blame gadgets, particularly smartphones, which have virtually tethered employees to their desks.?It took labor unions 100 years to fight for nights and weekends off, some say, while smartphones took them away in about three years.

Early Google Glass owners are dominated by developers and tinkerers, so it's only fair that they get easy access to the downloads they need. Appropriately, Google has quietly set up a page that centralizes both Glass images and kernel source code. The company has even saved owners from having to hack their eyewear the hard way -- one image comes pre-rooted for those willing to toss caution (and their warranties) to the wind. Most of us can't take advantage of these downloads for about a year or more, but those with early access can swing by the new code hub today.

The Nokia Lumia 521?has finally made its way to T-Mobile online.

T-Mobile is offering the Lumia 521 for one full payment of $149.99.

Customers, however, do have the option of putting a down payment of $29.99 and make $5 monthly payments for the next 24 months.

After choosing the method of payment, customers have to choose among three data plans, each with unlimited talk and text. The first data plan includes 500MB of high-speed data, while the second plan offers 2GB on top of the 500MB. The final data plan option is the Unlimited Nationwide 4G, a recommended choice by T-Mobile. Prices for the data plans vary, as the 500MB starts at $50, 2GB for $60 and $70 for the Unlimited Nationwide 4G, per month, respectively.

T-Mobile is also waiving the $35 activation free with the purchase of the Simple Choice Plan: Unlimited Talk and Text.

Additional services with each data plan include call forwarding, call hold, call waiting, caller ID, conference calling, and customer care.

The new Windows Phone 8 smartphone, exclusive to T-Mobile, has been available since May 11 at Microsoft Retail Stores for $149, Walmart, and even a showcase for HSN late last month, although for $0.95 more than Microsoft's offer.

The Lumia 521, which is 4G enabled, has a 4-inch touchscreen and 5-megapixel camera with 720p HD video recording. When it comes to memory, the smartphone has 8GB of internal storage with 512MB of RAM. A microSD card slot is available for up to 64GB of additional storage. The battery capacity for the Windows Phone 8 smartphone is 1,430mAh.

A stretched Samsung chases rival Apple's suppliers

SEOUL (Reuters) - Overtaking Apple Inc as the world's leading maker of smartphones has stretched Samsung Electronics Co's in-house supply lines, and the South Korean firm is now courting some of its rival's main parts suppliers.

After costly courtroom battles over technology patents, the two gadget giants are now going head-to-head over securing the best supply of parts as they jostle to rule the $253 billion smartphone market. The two took 100 percent of the industry's profit in January-March, Canaccord Genuity data show.

Trampling on Apple's supply patch could make life tough for the U.S. firm as it prepares for its next product line-up including a cheaper iPhone for emerging markets such as China. Having Samsung muscle in on its suppliers could drive up costs and lead to component bottlenecks, disrupting product launches.

Samsung's huge in-house supply chain - providing parts from displays and powerful processors to memory chips and batteries - has been a core strength in its war for smartphone supremacy. As it now looks to widen its lead with products spanning both the high and cheap-and-cheerful ends of the market, Samsung's supplies have become stretched, prompting it to hunt elsewhere to ensure it isn't caught short.

"The next round of the post-patent battle for them will be over component supplies," said Lee Sun-tae, an analyst at NH Investment & Securities. "Who wins access to the best performing components in class in large quantity - that's the key ... and explains why Samsung is shopping for components more than ever."

SHARP AND SOUR?

Samsung has made overtures to traditional Apple partners such as Japanese display maker Sharp Corp and South Korean chipmaker SK Hynix. Samsung, which buys most of its mobile screens from its Samsung Display unit, last year placed orders with Sharp for high-resolution LCD screens for its popular Galaxy range of products, though it later canceled the order, said two people familiar with the matter, asking not to be named as the negotiations were confidential.

Sharp, in which Samsung bought a 3 percent stake earlier this year for $110 million, said this week it was seeking to boost sales to the Korean firm, potentially souring the Japanese company's ties with Cupertino, California-based Apple.

Samsung is also using more chips made by Qualcomm, another major Apple supplier, in its flagship Galaxy S, which went on sale late last month.

Some other suppliers who provide parts to both Apple and Samsung include Toshiba Corp in NAND memory chips, Sony Corp, in image sensors, and Corning Inc for its Gorilla Glass used in iPhones, iPads and Galaxy products, industry data show.

STMicroelectronics and Bosch, the only mass producers of pressure sensors used in navigation features, supply those parts for the Galaxy range, and could be tapped by Apple for future products, according to research firm iSuppli.

TINY OVERLAP, BIG IMPACT

For sure, Samsung still buys the majority of its components in-house, and the overlap with Apple on external suppliers is, so far, limited. BNP Paribas estimates that more than 80 percent of component profits generated by Galaxy S4 sales go to Samsung itself and its units.

But even a tiny overlap can be damaging as smartphones are constantly upgraded to more powerful computing and media devices - allowing users to take pictures, shoot video, play music, game online, watch TV and navigate - raising the need for more and smarter components.

"Any disruption in even small parts that you wouldn't think are really core, say headphones, can affect product launches," said Lee at NH Investment & Securities.

For example, Taiwan's HTC Corp, which has slipped out of the top-10 smartphone makers, reported a record-low quarterly profit last month after delaying the full launch of its flagship model due to a shortage of cameras.

"Having a single supplier carries a lot of risk. Bearing that in mind, Samsung may even consider using LCD along with OLED in its signature Galaxy S range to reduce its total reliance on Samsung Display," said Song Jong-ho, an analyst at KDB Daewoo Securities.

Samsung Display doesn't produce LCDs for smartphones so as it boosts sales at the lower end of market it needs to outsource LCDs. The Korean firm uses the more expensive OLED display only on its high-end models.

NOT SO DIFFERENT

Outsourcing more components could mean Samsung will lose some of its hardware differentiation - a big selling point for the Galaxy range - and be seen as just selling generic phones, say some analysts.

The Exynos 5 Octa processor, which Samsung touted as having 8 brains designed to maximize energy efficiency while multi-tasking, is not used in the S4 models sold in the United States. Instead, Qualcomm's Snapdragon chips will power the phone in that crucial market, with Exynos chips used in select markets such as South Korea and some European countries.

"Given that Qualcomm chips are also found in rival products, and the much-heralded launch of smartphones with flexible display appears to be delayed, I'm worried Samsung is losing its hardware differentiator," said BNP Paribas analyst Peter Yu.

Samsung says both Qualcomm and its own chips have passed its rigorous quality standards and both will provide satisfactory user experience. "We'll continue to resort to multi vendors to ensure smooth supply," Kim Hyunjoon, vice president of Samsung's mobile business, told analysts on a recent earnings call.

Samsung's Exynos processors accounted for around 30 percent of the S3, but that is likely to fall to around 10 percent in the S4, analysts said.

"Qualcomm's latest chips are getting good reviews from carriers, which I think forced Samsung to switch in favor of Qualcomm from Exynos in the S4," said KDB Daewoo's Song. "There's even a possibility Apple may drop its own processor and go for Qualcomm chips in some future devices."

FLEXI-TIME?

Losing some of its hardware appeal and taking longer than expected to come up with innovative products such as flexible or wearable devices are additional challenges for Samsung, which is getting only mixed reviews for its efforts to improve software capability to integrate better with hardware.

In a recent review of the S4, Walt Mossberg, a gadget expert for the Wall Street Journal, said Samsung's software was "often gimmicky, duplicative of standard Android apps, or, in some cases, only intermittently functional.

Despite the lukewarm reviews, consumers keep snapping up the S4, according to carriers. For the first time in at least three years, Samsung last year spent more on marketing than on research and development, seeking to pick up market share in the absence of new, competing models from Apple. And Samsung's operating profit is seen topping Apple's this quarter for the first time in years, J.P. Morgan analysts predict.

"There's not much left in terms of what you can do to really differentiate your product as everybody's thinking something similar - flexible or wearable," said NH Investment & Securities' Lee.

In late 2011, Samsung told analysts it planned to introduce flexible displays on handsets "some time in 2012, hopefully the earlier part than later", but a year later it said the technology was still "under development." It again demonstrated prototypes of flexible phones earlier this year, but executives now say they can't disclose the timing of flexible smartphones.

Rivals are also moving fast. LG Electronics Inc, the third-biggest smartphone maker in January-March on strong sales of its high-end Optimus G model, said last month it planned to introduce an unbreakable smartphone by the year-end.

This case is significant because even as it applies the Supreme Court's recent ruling in Gunn v. Minton to find a lack of subject matter jurisdiction over state law tortious interference claims involving patent issues it also expressly suggests that there are limits to the effects of the Court's ruling.? This issue is particularly important to be cognizant of because, as here, a lack of subject matter jurisdiction can instantly reset a lawsuit regardless of how far along it has proceeded.?

Forrester, a player in the market for industrial and municipal waste treatment systems, sued competitor Wheelabrator in New Hampshire state court for a violation of the New Hampshire Consumer Protection Act, tortious interference with a contractual relationship, tortious interference with Forrester's prospective advantage, and trade secret misappropriation.? Forrester's claims were based on the allegation that in 2007, Wheelabrator met with Kobrin, a Taiwanese company that Forrester had a business arrangement with, telling Korbin that Wheelabrator's US patents covered the technology provided to Kobin by Forrester.? Forrester contended that this statement was false and that as a result of the false statement Korbin ended its arrangement with Forrester.

After Forrester filed its suit in state court, Wheelabrator removed the action to federal district court.? The district court summarily denied Forrester's remand motion and subesequently ruled in Wheelabrator's favor on all of Forrester's substantive claims.? Forrester appealed.

Patent law issue here not "substantial": The central issue on appeal was whether Forrester's state law claims necessarily raise a substantive issue of patent law because Forrester's allegations "necessarily require the trial court to construe the claims of the patent in order to determine whether the alleged statements were [] false."? Slip Op. at 8, quoting Wheelabrator's brief.? The Federal Circuit held that this did not raise a substantial issue of patent law here because, as in Gunn, there is "no prospect of future conflict between inconsistent judgments in state and federal courts."? Id. at 10.? Due to the? circumstances of this case, "there is no prospect of a future U.S. infringement suit arising out of Kobin's [operations in Taiwan]" and because the patents have all expired, there is "no prospect that future conduct in the U.S. could lead to an infringement suit regarding those patents."? Id.

The Federal Circuit also rejected Wheelabrator's specific argument that resolution of the claim construction issues necessarily would have potential preclusive effects in future litigation involving the patents.? "[T]he Supreme Court rejected a related argument in Gunn, concluding that any such collateral estoppel effect ?would be limited to the parties and patents that had been before the state court,? and that '[s]uch ?fact-bound and situation-specific? effects are not sufficient to establish federal arising under jurisdiction.'"? Id., quoting Gunn.?

Limits on Gunn: Even while concluding that here the district court did not have jurisdiction,?Forrester recognizes some potential limits when applying Gunn to state law claims:

In the past, we have concluded that similar state law claims premised on allegedly false statements about patents raised a substantial question of federal patent law. For example, in Additive Controls & Measurement Systems, Inc. v. Flowdata, Inc., we concluded that the plaintiff?s state law business disparagement claims arose under patent law for the purposes of 28 U.S.C. ? 1338. [] We noted that under state law, ?a business disparagement claim requires [the] plaintiff to prove . . . the falsity of [the] defendant?s allegedly disparaging statements.? []? There, the allegedly disparaging statement was an accusation of patent infringement; thus, we concluded that in order to prove the falsity of that statement, the plaintiff would have to ?show that its product does not infringe the . . . patent.? [] Reasoning that the infringement issue presented a substantial question of patent law, we concluded that the claims arose under federal patent law for the purposes of ? 1338. Those cases may well have survived the Supreme Court?s decision in Gunn. Unlike the purely ?backward looking? legal malpractice claim in Gunn, [], permitting state courts to adjudicate disparagement cases (involving alleged false statements about U.S. patent rights) could result in inconsistent judgments between state and federal courts. For example, a federal court could conclude that certain conduct constituted infringement of a patent while a state court addressing the same infringement question could conclude that the accusation of infringement was false and the patentee could be enjoined from making future public claims about the full scope of its patent as construed in federal court.?

Afghanistan: Bomb kills 15, including 2 Americans

KABUL, Afghanistan (AP) ? The U.S. military says two American service members are among the 15 dead in a car bomb attack in Kabul.

The suicide attack Thursday on a convoy also killed four foreign contractors and nine Afghan civilians.

Cmdr. Bill Speaks, a spokesman for the U.S. Defense Secretary, confirmed that two U.S. soldiers in the NATO military coalition were killed in the attack.

A Islamic militant group, Hizb-e-Islami, claimed responsibility for the early morning attack, saying it had formed a new unit to attack foreign forces.

Obama: IRS acting commissioner has resigned

WASHINGTON (AP) ? President Barack Obama on Wednesday announced the resignation of the top official at the Internal Revenue Service following a controversy over the agency's targeting of conservative political groups.

Obama, who has been criticized for appearing passive in his response to the matter, declared, "I am angry about it" and said the American people had a right to be angry as well.

Before announcing the resignation of Acting IRS Commissioner Steven Miller, Obama met at the White House with top officials from the Treasury Department, which oversees the IRS. The White House scheduled the meeting a day after the release of an inspector general report that showed ineffective management at the IRS allowed agents to improperly target tea party groups for more than 18 months.

Miller became acting commissioner in November, after Commissioner Douglas Shulman completed his five-year term. Shulman had been appointed by President George W. Bush.

The president has proceeded cautiously since the IRS controversy was made public Friday. While he initially said the accusations were "outrageous," he also said he wanted to wait until the inspector general's report was released before addressing what should be done to hold accountable those responsible.

The report lays much of the blame on IRS supervisors in Washington who oversaw a group of specialists in Cincinnati who screened applications for tax exempt status. It does not indicate that Washington initiated the targeting of conservative groups, but it does say a top supervisor in Washington did not adequately supervise agents in the field even after she learned the agents were acting improperly.

The Justice Department is also investigating the IRS targeting, as are three congressional committees.
